The Truth About Texas

I have been doing a little research about my new home state after a few people gave me some disturbing “facts” about Texas. I was told two things:

  1. Texas, has in it's state constitution, the right to succeed.
  2. Texas is the only state whose flag code allows its state flag to fly at the same height as the U.S. flag.

Both of the assertions have now been proven to be nothing more than myth.

As to the first point, Texas never asserts the right to succeed. The Constitution of Texas declares that it is a “free and independent state” but yields ultimate authority to the U.S. Constitution. Here is Article I Section 1.


FREEDOM AND SOVEREIGNTY OF STATE. Texas is a free and independent State, subject only to the Constitution of the United States, and the maintenance of our free institutions and the perpetuity of the Union depend upon the preservation of the right of local self-government, unimpaired to all the States.

Second, all states have the right to fly their state flags at the same height as the United States flag. Height does not determine the flags position of honor, yet position does. The UNITED STATES CODE TITLE 36 CHAPTER 10 SS175.(c) states that “No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America.” So all types of flags can be at the same level or below the U.S. flag as long as it is to the left of the U.S. flag.

So to the assertion Texas has too much pride because of these two items … all I can say is perhaps they have pride but not because of those reasons.
